What is the Special Civil Part?

 

The Special Civil Part is a section of the Law Division of New Jersey Superior Court. In the Special Civil Part, cases are typically tried by a judge without a jury. The costs for filing cases are lower, and trials are scheduled and completed more quickly than in other parts of the Superior Court. The cases that are filed and heard in this section of the court are normally presented relatively quickly and inexpensively, often without a lawyer. In addition, the rules and time periods for each party to gather information and find out what the other party knows (discovery) are streamlined. Each county courthouse has a Special Civil Part, which itself has three separate sections: Small Claims, Landlord/Tenant, and Special Civil Part.
